Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of Need Theo's AI-powered communication platform ("Service"). This policy is designed to protect Need Theo, our users, and the general public from harmful, illegal, or abusive activities. Violation of this AUP may result in suspension or termination of your account.
1. Prohibited Activities
You may not use the Service to:
1.1 Illegal Activities
- Violate any applicable laws, regulations, or legal obligations
- Engage in fraud, phishing, or other deceptive practices
- Facilitate illegal transactions or money laundering
- Infringe on intellectual property rights of others
- Violate wiretapping, call recording, or telecommunications laws
1.2 Harmful Content
- Distribute malware, viruses, or other harmful code
- Create AI agents that generate hate speech, harassment, or discriminatory content
- Produce or distribute sexually explicit or exploitative content
- Generate content that promotes violence or terrorism
- Create misleading or deceptive AI impersonations
1.3 Abuse and Harassment
- Harass, threaten, or intimidate individuals
- Stalk or engage in unwanted contact
- Send unsolicited bulk communications (spam) via any channel, including email, SMS, or chat
- Conduct robocalling or automated calling without proper consent
1.4 System Abuse
- Attempt to gain unauthorized access to the Service or other systems
- Interfere with or disrupt the Service or its infrastructure
- Circumvent usage limits, rate limiting, or security measures
- Use the Service for cryptocurrency mining or similar activities
- Reverse engineer, decompile, or attempt to extract source code
2. Call Recording and Voice Agent Compliance
When using voice agents that record calls, you must:
- Obtain Consent: Comply with all applicable federal, state, and local laws regarding call recording consent. Many jurisdictions require all-party consent.
- Provide Disclosure: Configure appropriate welcome messages that clearly inform callers that the call may be recorded.
- AI Disclosure: Where required by law, disclose that callers are interacting with an AI agent.
- Maintain Records: Keep records of consent and compliance measures.
Failure to comply with call recording laws may result in significant legal liability. You are solely responsible for understanding and complying with applicable laws in your jurisdiction.
3. SMS/Text Messaging Compliance
When your AI agents send SMS/text messages through the Service, you must comply with all applicable laws and regulations, including:
3.1 TCPA Compliance
The Telephone Consumer Protection Act (TCPA) and related regulations govern the sending of text messages. You are responsible for:
- Obtaining Prior Express Consent: Ensuring that recipients have provided consent to receive text messages before their phone number is used for SMS communication through the Service.
- Honoring Opt-Out Requests: Need Theo processes STOP requests automatically, but you must not attempt to circumvent opt-out mechanisms or re-add opted-out numbers.
- Maintaining Consent Records: Keeping records of how and when consent was obtained for each recipient.
3.2 SMS Content Requirements
When configuring AI agents that may trigger SMS messages, you must ensure:
- Messages are related to legitimate business communications (appointment confirmations, requested information follow-ups)
- Messages do not contain deceptive, misleading, or prohibited content
- Messages are sent only to phone numbers voluntarily provided during interactions
- Message content is appropriate and relevant to the recipient's interaction
3.3 Prohibited SMS Activities
You may not use the SMS capabilities of the Service to:
- Send unsolicited marketing or promotional text messages
- Send messages to numbers that have opted out
- Send messages unrelated to the customer's interaction with your AI agent
- Exceed reasonable message volumes or send repetitive messages
- Share or sell phone numbers or opt-in data obtained through the Service
Failure to comply with SMS regulations, including the TCPA, may result in significant legal liability. You are solely responsible for understanding and complying with applicable laws in your jurisdiction.
4. Content Guidelines for AI Agents
When configuring AI agents, ensure they:
- Provide accurate and truthful information about your business
- Do not make false claims or guarantees
- Respect user privacy and handle personal data appropriately
- Do not engage in high-pressure sales tactics or manipulation
- Clearly identify themselves as AI when required or requested
- Gracefully handle situations they cannot address and escalate appropriately
5. Resource Usage
You agree to use the Service responsibly:
- Stay within your allocated credits and resource limits
- Do not create artificial load or conduct stress testing without prior approval
- Do not resell or redistribute access to the Service without authorization
- Report any bugs or vulnerabilities responsibly
6. Data Protection
When handling data through the Service:
- Comply with applicable data protection laws (GDPR, CCPA, etc.)
- Only collect and process data for legitimate purposes
- Implement appropriate security measures for sensitive data
- Honor data subject rights and deletion requests
- Do not use the Service to collect data from minors without proper consent
7. Industry-Specific Requirements
If you operate in a regulated industry, you are responsible for ensuring your use of the Service complies with applicable industry regulations, including but not limited to:
- Healthcare (HIPAA): Ensure appropriate safeguards for protected health information
- Finance: Comply with financial services regulations and disclosure requirements
- Legal: Maintain attorney-client privilege where applicable
- Real Estate: Follow fair housing and disclosure requirements
8. Reporting Violations
If you become aware of any violation of this AUP, please report it immediately to abuse@needtheo.com. We take all reports seriously and will investigate promptly.
9. Enforcement
We reserve the right to investigate suspected violations of this AUP. Depending on the severity of the violation, we may take the following actions:
- Warning: Notify you of the violation and request correction
- Suspension: Temporarily suspend your account pending investigation
- Termination: Permanently terminate your account for serious violations
- Legal Action: Pursue legal remedies for violations causing harm
We may report violations to law enforcement where required or appropriate.
10. Changes to This Policy
We may update this AUP from time to time to address new issues or reflect changes in our Service. We will notify you of material changes. Continued use of the Service after changes become effective constitutes acceptance of the revised policy.
